Terms of Use (ToU)

Please read the Terms of Use carefully before using this application.
These Terms of Use (“ToU”) govern your use of JAIYA’s mobile applications, websites, products, content, features, and platform (collectively, the “PLATFORM”).
By confirming your acceptance of these ToU or by using the Platform, you enter into a contract with us. The company you contract with depends on your location. In Morocco, you enter into a contract with AMS (SARL) (“JAIYA”).
The PLATFORM is owned and operated by JAIYA, which reserves the right to modify or discontinue, temporarily or permanently, at any time, the PLATFORM and/or its services with or without notice. You agree that JAIYA shall not be liable to you or any third party for any modification, suspension, or discontinuation of the services.
Additional conditions may apply to specific categories for deals and promotions posted on the PLATFORM. Our privacy practices are described in the Privacy Policy.
JAIYA is an online aggregator and does not participate in any cooperation between its users, without exception: users create and place all requests and orders within the application on their own initiative.
Users offering a transport service are required to possess the necessary authorizations to operate on Moroccan territory, or to offer the service for free in the absence of a license, or to offer a carpooling service under Decree No. 2-10-314 of September 29, 2010 issued for the application of Law No. 52-05 on the road code regarding professional driving, Article 1.
Drivers are required to obtain a professional driver’s card only for vehicles of categories 3 and 4.
The commission retained by our company represents the estimated costs for the use of our servers and technology, and all taxes are declared according to the applicable laws in Morocco.
1. User Declaration
To maintain the quality of our services, by using the PLATFORM, you agree to comply with these Terms of Use, which constitute a legally binding agreement between you and JAIYA:
1.1.
All registration information you submit is truthful and accurate, and you will maintain the accuracy of this information.
1.2.
You will keep your own data and the data of individuals you interact with on the PLATFORM confidential, and you are responsible for any activity conducted through your account.
1.3.
You are a woman, and you are not a minor under Moroccan law (generally under 18). If you are a minor under Moroccan law, you must have permission and be under the direct supervision of your parent or legal guardian to use the PLATFORM; and your parent or legal guardian must read and accept the ToU before your use.
1.4.
You agree that JAIYA may modify these terms from time to time, and any modification will be reflected on the PLATFORM (with revisions indicated by date dd.mm.yyyy). You agree to be bound by any modifications when you use the PLATFORM or its services. JAIYA may, at its sole discretion, choose whether or not to notify users by phone, SMS, or WhatsApp. It is therefore important that you review the ToU regularly.
1.5.
You understand and accept that, from time to time, there may be information on the PLATFORM or within the services containing typographical errors, inaccuracies, or omissions relating to service descriptions, pricing, availability, and other details. JAIYA reserves the right to correct any error, inaccuracy, or omission and to change or update information at any time without notice.
1.6.
Your use of the PLATFORM does not violate any applicable law.
2. JAIYA Services
2.1.
Our platform connects independent female driver-users (“PILOTE”) with passenger-users (“COPIL”). When a COPIL requests a ride, the PLATFORM proposes an honorary amount to share travel costs. The PILOTE receiving the request may accept or decline it depending on her route.
2.2.
The COPIL pays the PILOTE directly the amount mutually agreed upon through the platform. This amount includes all costs related to the trip (tolls, taxes, commissions, etc.). JAIYA does not intervene in and does not influence this contractual agreement between the two users.
2.3.
JAIYA is a Moroccan technology company and does not itself provide any transport services. These services are provided exclusively by independent PILOTEs via the PLATFORM. Any decision to offer or accept a service lies solely with each user, who acts at their own risk.
2.4.
JAIYA exercises no direction or control over PILOTE users and/or COPIL users, whether in general or in connection with the performance or acceptance of services.
2.5.
Any features, procedures, or measures implemented to improve the user experience should never be interpreted as creating an employment or agency relationship with any user.
These Terms do not cancel or modify any agreements that may be concluded directly between Passengers and Drivers regarding the provision of services.
Towards Users (Service Providers)
1. Processing Your Data
In accordance with Decree No. 2-09-165 of 25 Joumada I (May 21, 2009) issued under Law No. 09/08 relating to the protection of individuals with regard to the processing of personal data, the information you provide when subscribing to this service will not be used for any other purpose.
Through this form, AMS SARL collects your personal data for the purpose of connecting users with one another.
Your data may be transmitted, for your safety, to the relevant authorities.
This processing has been the subject of an authorization request to the CNDP.
You may exercise your rights of access, rectification, or objection in accordance with Law 09/08 by contacting the administration at: contact@Jaiya.ma
2. Fair Admission Requirements
Provide clear and fair criteria for driver admission, taking into account the skills, experience, and qualifications needed to deliver a quality service. Drivers must meet the acceptance criteria defined by the application, including having a valid and trusted driver’s license, a vehicle that meets required standards, etc.
3. Support and Assistance
Provide adequate support to drivers by responding to their questions, offering technical assistance if they encounter issues with the application, and ensuring effective communication channels with the company.
4. Training and Development
Offer training and development programs to help drivers improve their skills and their understanding of the application and customer service.
5. Fair Compensation
Ensure drivers receive fair compensation for their work through transparent pricing policies and clear payment mechanisms.
6. Use of the Application
Drivers must follow the application’s guidelines when accepting rides, following recommended routes, and using all app features correctly.
7. Respecting Customers
Drivers must treat customers with respect, kindness, and professionalism. Any form of discrimination, intimidation, or inappropriate behavior toward customers is strictly prohibited. In case of violation, the driver will be removed and authorities will be informed.
8. Service Quality
Drivers must keep their vehicle clean, provide courteous service, respect agreed schedules, and ensure the comfort and safety of passengers.
9. Pricing and Payment
Drivers must follow the pricing set by the application, provide accurate receipts to customers, and respect billing rules in case of variable pricing.
In addition to the fare set by the applicable regional directives, the fixed service fee is added.
10. Confidentiality and Personal Data
Drivers must respect the confidentiality of customer information and must not disclose personal data to third parties, in accordance with the app’s privacy rules.
11. Equipment and Maintenance
Drivers must ensure their vehicle is well-maintained, undergoes regular inspections, and is in proper working condition to provide safe and reliable service.
12. Dispute Resolution and Complaints
In case of a dispute with a customer, drivers must cooperate with the dispute resolution team and seek a compromise within the company’s policy.
If no amicable resolution is reached, both parties (drivers and users) retain the right to pursue legal action. The company, as a third party, retains the right to provide testimony and transfer logs upon request by the relevant authorities.
13. Evaluation and Feedback
Drivers will be rated by customers after each ride and must accept constructive feedback and strive to improve their service based on user comments.
Towards Users (Passengers)
14. Processing Your Data
In accordance with Decree No. 2-09-165 of 25 Joumada I (May 21, 2009) issued under Law No. 09/08 related to personal data protection, the information you provide when subscribing to this service will not be used for any other purpose.
Through this form, AMS SARL collects your personal data for the purpose of connecting users.
Your data may be transmitted, for your safety, to the relevant authorities.
This processing has been the subject of an authorization request to the CNDP.

15. Services Provided
Provide booking services with taxi drivers, allowing users to schedule trips based on their specific needs, offering responsive service for requests and issues, and handling complaints and disputes (see clause 12).
16. Booking and Use of Services
Users may book a taxi via the application by specifying the time, date, and pick-up location.
Fees may apply in cases of late cancellation, route changes, or failure to respect the agreed timing.
17. User Safety
Ensure user safety through driver background checks, providing trip details, and offering reporting tools for any issue during the journey.
18. Transparency of Prices and Payments
Clearly inform users about pricing, terms of use, cancellation policies, possible fees, and payment methods.
The price is calculated based on the applicable fare plus the service fee.
Users may pay in cash or via the application using secure payment methods such as credit card payments through third-party services.
19. User Responsibilities
Users must respect drivers and other passengers, keep the vehicle clean, comply with laws and regulations, and follow safety instructions.
20. Cancellation and Refunds
Cancellations must be made in a timely manner to avoid fees. Specific refund conditions may apply and administrative fees may be charged.
21. Protection of Personal Data
The company commits to protecting users’ personal information in accordance with applicable privacy laws and will not share it without user consent, unless required by law.
22. Safety and Liability
The company commits to providing safe and reliable services. In case of an incident or issue, users are requested to report the situation immediately to the company.
23. Intellectual Property
The trademarks, logos, content, and other intellectual property elements of the application are owned by the company and may not be used without prior authorization.
24. Modification of the Terms and Conditions
The company reserves the right to amend these terms and conditions. Users will be notified of changes through the application, notifications, or email.
25. Service Quality
Ensure service quality by encouraging users to provide feedback, taking action against drivers who fail to meet service standards, and using feedback to improve overall service.
